1. Scope
These Terms of Service (ToS) apply to the use of the Spoxit platform operated by [Company Name] (hereinafter "Provider"). By registering on the platform, the user agrees to these ToS.
2. Registration and Accounts
The creation of an account is a prerequisite for using the platform. The user is obligated to provide truthful information and keep their access data secret. Accounts are not transferable.
3. User Obligations
The user agrees to use the platform exclusively for legal and contractually compliant purposes. Athletes and sponsors may only publish accurate information about themselves, their performances, and their sponsorship requests or offers.
4. Prohibited Conduct
It is prohibited to:
- Publish offensive, racist, or otherwise unlawful content.
- Use the platform for spam, phishing, or spreading malware.
- Use automated scripts (bots, scrapers) for data collection.
- Impersonate another person or company.
5. Sponsorship Agreements (Disclaimer)
Spoxit solely provides the platform for making contact ("Matchmaking"). The Provider is not a party to sponsorship contracts concluded between athletes and sponsors. The respective parties are solely responsible for the fulfillment of these contracts.
6. Intellectual Property
All content provided on the platform (design, text, logos) is protected by copyright. The user grants the Provider a simple right of use to display the content uploaded by them (e.g., profile pictures, logos) on the platform.
7. Limitation of Liability
The Provider is liable without limitation for intent and gross negligence. For slight negligence, the Provider is only liable in the event of a breach of material contractual obligations (cardinal obligations). Liability for indirect damages, especially lost profits, is excluded.
8. Termination
The user can delete their account at any time. The Provider reserves the right to suspend or delete accounts without notice if there is an important reason (e.g., violation of these ToS).
9. Governing Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the user is a consumer, mandatory consumer protection regulations of their country of residence remain unaffected.
10. Dispute Resolution
The place of jurisdiction for all disputes arising from or in connection with these ToS is the Provider's registered office, provided the user is a merchant, a legal entity under public law, or a special fund under public law.
